1. Purpose
This policy keeps our network safe and reliable for all customers. It forms part of our Terms and Conditions.
2. Unlawful content
You must not host, send or link to content that is unlawful in Australia, including material that infringes copyright or trade marks, is defamatory, breaches privacy, or is restricted or prohibited under the Online Safety Act 2021 and its industry codes.
3. Harmful activity
You must not use the services for malware, phishing, scams, fraud, illegal gambling, hacking or scanning other systems, denial of service attacks, or to access systems without authorisation.
4. Email
You must not send spam or any commercial email that breaches the Spam Act 2003, use purchased or harvested lists, or forge headers.
5. Fair Use Policy
Unlimited means we do not meter or charge for bandwidth (data transfer) or disk space on plans advertised as unlimited, provided your use is normal for a website and its email.
- (a) Resource limits: each plan has fixed limits on CPU, memory (RAM), disk input and output (IO), processes and inodes (the number of files and folders), shown on the plan page and in your control panel. If your site reaches a limit it may slow down or briefly show a ‘resource limit reached’ error until usage falls; this is not an outage under the Service Level Agreement.
- (b) What is not fair use: storing files, backups, media or archives unrelated to your hosted website or email; file sharing, streaming or download mirrors; cryptocurrency mining; running persistent background processes or daemons; or any use that consistently runs at or near a plan limit or degrades service for other customers.
- (c) If you exceed fair use: we will contact you, explain what we found, and give you at least 7 days to reduce your usage or move to a suitable plan, and help you optimise where we can. We will only throttle or suspend a service without notice where its usage is harming other customers or our network, and we will tell you promptly when we do.
- (d) No surprise charges: we never charge excess usage fees. Any plan change happens only with your agreement.
6. Security
You must keep software you install patched, use strong passwords, and tell us promptly if you believe your account has been compromised.
7. Our response
We will act in proportion to the breach: usually notice and at least 7 days to fix it, and immediate suspension only for the cases listed in clause 10 of the Terms and Conditions. We may act on lawful requests from police, courts, regulators and the eSafety Commissioner.
8. Reporting abuse
Report abuse to support@uptimewebhosting.com.au with as much detail as possible.
